Terms of Service

By creating an account, submitting a care request, or otherwise using the Angels Over Us platform (the "Service"), you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization or another individual, you represent that you have the authority to bind that party to these Terms.

Angels Over Us provides non-medical home care services, including but not limited to companion care, personal care, respite care, dementia care, post-surgery support, and chaperoned transportation. Our platform facilitates care requests, caregiver matching, scheduling, and communications between clients, caregivers, and our staff.

Our services are not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns. In a medical emergency, call 911 immediately.

To access certain features, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your password confidential and notify us immediately of unauthorized access
• Be responsible for all activity that occurs under your account
• Not share your account credentials with others
• Not create accounts for fraudulent or deceptive purposes

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Advance Payment: Payment for care services is required in advance via credit or debit card processed through Stripe. Services will not be scheduled until payment is confirmed. By providing payment information, you authorize us to charge the applicable fees.

Cancellation Policy: You may cancel or reschedule a scheduled care session with at least 24 hours' notice prior to the scheduled start time without penalty. Cancellations made with less than 24 hours' notice may be charged a cancellation fee equal to the cost of the cancelled session.

Refund Policy: Approved refunds for cancelled sessions (with proper notice) will be issued to the original payment method within 5–10 business days. No refunds will be issued for services rendered or for late cancellations, except at our sole discretion.

All fees are subject to change with reasonable notice. Continued use of services after a fee change constitutes acceptance of the new rates.

Our messaging platform is provided for care coordination between clients, caregivers, and Angels Over Us staff. It is not intended for emergency communications. If you have a medical or safety emergency, call 911 immediately.

All messages sent through our platform may be monitored and reviewed by Angels Over Us staff for quality assurance, safety, and compliance purposes. Do not share sensitive financial information (such as full payment card numbers) through messaging.

When you provide your mobile phone number and consent to receive SMS messages, you agree to receive text messages from Angels Over Us including appointment reminders, care updates, and service notifications.

SMS consent is not a condition of receiving care services. See our Privacy Policy for more details on our SMS practices.

All content on the Angels Over Us platform — including text, images, logos, graphics, software, and data — is owned by or licensed to Angels Over Us and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our content without our prior written consent. The Angels Over Us name and logo are trademarks of Angels Over Us and may not be used without permission.

To the maximum extent permitted by applicable law, Angels Over Us and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) our services.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the greater of (a) the total fees paid by you to Angels Over Us in the three (3) months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow limitation of implied warranties or liability for incidental or consequential damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Angels Over Us and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Service.

Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Springfield, Illinois, or virtually if agreed. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree to resolve disputes with Angels Over Us on an individual basis only and waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date, or by sending you an email notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may terminate your account by contacting us at caresupport@angelsoverusIL.com.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including payment obligations, intellectual property, limitation of liability, and dispute resolution) shall survive.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Angels Over Us regarding the Service and supersede all prior agreements, representations, and understandings.
